Terms of Use

These Terms of Use ("Terms") are an agreement between you and Believe In Yourself Psychotherapy LLC ("we," "us," or "our"), the provider of the Pretzel mobile application ("Pretzel" or "the app").

1. Acceptance of these Terms

By downloading, installing, or using Pretzel, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.

2. Eligibility

You must be at least 13 years old to use Pretzel. If you are under 18, you may use the app only with the permission of a parent or legal guardian who agrees to these Terms on your behalf.

3. IMPORTANT: Pretzel is a wellness tool, not therapy

• No therapist–client relationship. Using Pretzel does not create a therapist–client, provider–patient, or any other professional relationship between you and Believe In Yourself Psychotherapy LLC, its members, or anyone else.
• The AI coach is software. Coach responses are generated by an AI model. They are not the advice of a licensed clinician and may be inaccurate or incomplete. Do not rely on the app for medical or mental health decisions.

If you are experiencing a mental health condition, please seek care from a qualified professional.

4. Subscriptions — Pretzel Pro

Parts of the app are unlocked by Pretzel Pro, an auto-renewing subscription priced at $24.99 per year (local pricing may vary).

• Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
• The subscription renews automatically unless you cancel at least 24 hours before the end of the current billing period.
• You can manage or cancel the subscription at any time in your App Store or Google Play account settings; deleting the app does not cancel it.
• Billing, renewals, and refunds are handled by Apple or Google under their own policies — we do not process payments and cannot issue refunds directly.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription. Prices may change; changes apply only to renewals after notice through the store.

5. Your content

Everything you create in Pretzel — your Identity Statement, journal entries, logs, homework, story timeline, favorites, and settings — is stored on your device only, as described in the Privacy Policy. You own your content. We keep no copies, so you are responsible for exporting your data (Settings → Export) before deleting the app or switching devices; if you delete the app without exporting, your data cannot be recovered.

6. Acceptable use

You agree to use Pretzel only for lawful, personal, non-commercial purposes. You will not:

• copy, modify, distribute, sell, or lease any part of the app, or reverse engineer or attempt to extract its source code, except where the law permits;
• probe, disrupt, overload, or abuse the app or the optional cloud-coach relay, or attempt to circumvent its rate limits or access controls;
• use the app or the AI coach to generate content that is unlawful or harmful to others, or misrepresent coach output as professional advice;
• use the app in any way that violates applicable law.

We may suspend or terminate access to the cloud-coach service for abuse.

7. Intellectual property

The app — including its design, text, exercises, audio, and other content we provide — is owned by or licensed to Believe In Yourself Psychotherapy LLC and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes. This license does not apply to your own content, which remains yours (Section 5).

8. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY CONTENT (INCLUDING AI COACH RESPONSES) WILL BE ACCURATE OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BELIEVE IN YOURSELF PSYCHOTHERAPY LLC AND ITS MEMBERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE APP. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US THROUGH THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE, OR TWENTY-FIVE DOLLARS ($25), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "last updated" date above and, where appropriate, provide notice in the app before the changes take effect. Continuing to use the app after changes take effect means you accept the updated Terms.

11. Termination

You may stop using the app at any time. We may suspend or terminate your access to the app or its online services if you violate these Terms. Sections 3, 5, and 7–12 survive termination.

12. Governing law

These Terms are governed by the laws of the State of [STATE], United States, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in [STATE], and you consent to their jurisdiction.
